Prohibitions and regulations with respect to sale of poisons
6. —(1) It shall not be lawful —(a) for any person to sell any poison unless —(i) he is licensed under this Act to sell poisons;(ii) the sale is effected in accordance with the provisions of the licence and with any conditions specified therein;(iii) the sale is effected on the premises specified in the licence;(iv) the sale is effected by or under the personal supervision of the person named in the licence; and(v) the sale is effected by or under the personal supervision of a pharmacist; or(b) for any person to sell any poison by way of wholesale dealing except to a person licensed under this Act to sell that poison.
Possession of poisons
9. —(1) No person whether licensed under this Act or not shall knowingly keep or have in his possession or under his control any poison otherwise than —(a) in an unbroken case or package as received from the manufacturer; or(b) in a bottle, vessel, box, package or other receptacle distinctly labelled with the name of the substance contained therein and bearing some distinction or mark indicating that it contains poison. (2) In any proceedings under this section if any person is proved to have kept or had in his possession or under his control any poison he shall be deemed to have done so knowingly unless the contrary is proved by him. (3) No person shall keep any poison for sale or for dispensing purposes except —(a) as provided in subsection (1) (a);(b) in a bottle or other vessel tied over, capped, locked or otherwise safely secured in a manner different from that in which bottles or vessels containing non-poisonous substances are secured in the same warehouse, shop or dispensary;(c) in a bottle or other vessel readily distinguishable by touch from the bottles or vessels in which non-poisonous substances are kept in the same warehouse, shop or dispensary; or(d) in a bottle, vessel, box or package kept in a room or cupboard under lock and key set apart for the keeping or storage of dangerous substances.
Penalties
16. —(1) Any person who acts in contravention of any of the provisions of this Act shall, except in so far as his act comes within one of the exemptions made by sections 7 and 8, be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 2 years or to both.

(2) Any poison in respect of which an offence has been committed in contravention of any provision of this Act or of any rules made thereunder by any unlicensed person shall, upon that person being convicted of that offence, be forfeited and shall be handed over to the Chief Executive of the Authority for disposal. (3) Every penalty or forfeiture imposed under this Act shall be in addition to and not in substitution for any other penalty to which the accused may be liable under any other written law and no conviction under this Act shall be pleaded in any civil proceedings in mitigation of damages claimed against the person convicted. (4) Where an agent or employee, in the course of his employment, does, or omits to do, an act the doing of which or omission to do which by his principal or employer would be an offence under this Act or any rules made thereunder he shall be guilty of that offence, and, where it is proved that the act or omission was committed with the consent or connivance of, or is attributable to any neglect on the part of, his principal or employer, the principal or employer shall be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly. (5) Where an offence committed by a body corporate under this Act or any rules made thereunder is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other similar officer of the body corporate or any person purporting to act in any such capacity, he, as well as the body corporate, shall be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.
Prohibition of sale to persons below 18 years
19. —(1) No poison shall be sold to any person below 18 years of age. (2) Any person contravening this section shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000 or to imprisonment for a term not exceeding 6 months or to both.

(3) It shall be a sufficient defence to any charge under subsection (2) that the person charged had reasonable cause to believe that the person to whom the sale was made was above the age of 18 years.Please feel free to report any person that continue to sell banned products and contact HSA or the police.

THE Health Sciences Authority (HSA) on Friday ordered a recall of 'Menergy MEssence' capsules from the market after it found two undeclared chemical substances used in treatment of male erectile dysfunction.
The two substances - acetildenafil and acetilacid - were detected by HSA through its ongoing post-market surveillance programme. They were not included in the product label.
Both substances are chemically similar to sildenafil, a potent prescription drug used for treatment of male erectile dysfunction, which should only be used when prescribed by a doctor, said the HSA in a statement on Friday.
Consumption of the two substances can potentially cause serious adverse reactions such as heart attack, stroke and severe hypotension, especially in susceptible individuals such as those with heart conditions or who are taking nitrate drugs.
'While there have not been any cases of adverse reactions relating to the consumption of this product, HSA has ordered a recall of this product from the market as the safety of this product is in question,' said the authority.
HSA also warned the public not to consume any stocks that they may have. If they have consumed the capsules and feel unwell, they should seek medical advice.
The capsules are distributed in Singapore by LFI (Singapore) Pte Ltd.
HSA has ordered the company to suspend sales and to recall the product from the market. It is monitoring the recall to ensure that stocks are being removed from the market as swiftly as possible.
Said Ms Ruth Lee, HSA's Deputy Director (Enforcement Operations) of the Health Products Regulation Group: 'While HSA conducts ongoing surveillance to check the safety of health products in the market, consumers can play a vital role in safeguarding their own health by being cautious and exercising discretion in the choice of health products they buy'.
'Anyone who has specific medical concerns should consult a doctor instead of resorting to dubious products touting unproven claims. HSA would also like to take this opportunity to remind members of the public not to purchase health products from unknown and ambiguous Internet sources.'

KUALA LUMPUR, June 11 (Bernama) -- The public are advised to be beware of "Mentalk Candy", a type of confectionary for health, which has been found to be laced with aminotadalafil, a type of medicine to treat erectile dysfunction.
Health Ministry Pharmaceutical Services Division warned that consuming the candy may result in heart failure and depression apart from loss of sight on its prolong use or by taking it at a higher dose.
Although Tadalafil has been confirmed safe for the treatment of erectile dysfunction, the safety profile of its analogue, in contrast, has never been tested and it appears to be a new chemical entity which has never been detected, the division said in a statement.
"Mentalk Candy believed to be used for the same propose (erectile dysfunction) can be dangerous if consumed because of the pharmacological side effects of the analogue in the human body," it said.It urged the public to report to the authority if the product is still available in the country and warned manufacturers and distributors that they can be prosecuted under the Poisons Act 1952, which carries a fine not exceeding RM5,000 or jail not exceeding two years or both, if found guilty.

Channel NewsAsia - Sunday, June 1SINGAPORE : A dangerous substance has been found in a brand of candy called "Mentalk".
The Health Sciences Authority (HSA) said it has detected the undeclared chemical substance aminotadalafil in the ginseng and coffee candy. The substance is similar to tadalafil, which is used to treat impotence.
HSA warned that aminotadalafil can cause serious adverse reactions such as heart attacks and strokes in susceptible individuals.
Heart patients who are on nitrate drugs may suffer severe hypotension, which could be fatal.
HSA has advised the public not to buy or eat the candy.
It said that based on current information, the candy is sold over the Internet and possibly through multi—level marketing.
HSA is working with the relevant agencies to determine the extent of its distribution and sales channels for follow—up action.
Anyone who feels unwell after eating the candy should see their doctor immediately. — CNA/ms

Suggested to them to put a proper medical sales training and evaluation system in place to ensure their agents are properly trained and evaluated. Regular knowledge updating and training seminars to be set up and be made available as a means of continuous learning for all agents.
Are you making a official statement that CAD should investigate LFI and you are calling LFI a scam? Do you have the evidence at hand and can you be called to be a witness in a court of law at this very moment? I would advise caution with your statements.
As I emphasize again, they must be prepared to answer our queries because of the way some of their agents are recruiting. I have nothing against the products or pageants but the way they go about recruiting or selling their packages. If they dont have a system in place to check the activity of these agents, they will realise that the company's reputation will be badly affected by these agents. Dont you agree? Do you think its right to ask people to pay 700 bucks to join a pageant and promise glory in Miss Singapore when LFI is not even the organiser for that pageant? You have not make a statement on the question posed originally. Make a stand first, then talk.
Anyway, you have left the company and should not be seen as a official spokesperson for the company. Your way of answering the questions will affect our impression of your present company BWL, which does in fact have a proper complain handling mechanism in place. I am sure BWL will be interested to know who are their agents who goes around calling people names and calling them "barking dogs". You are representing BWL, a publicly listed company which has a lot more moral obligations, commitment and responsibility towards the general public.

Yup I have a lot of free time because I dont agree with the recruitment method for the pageant. If there is nothing to hide, why cant you answer the questions? If you are not qualified to answer them, you can consult the relevant authorities and give a answer.
You think you cant handle the general public's queries and start bashing/distracting them and make personal attacks? Standard LFI response system? You do represent them right?
