Rexdriver: In this case, she was charged under Section 28 of the Wholesome Meat and Fish Acts, Chapter 349A I believe for obstruction. Section 28 is reproduced as below:
"Any person who obstructs, hinders or impedes the Director-General or any authorised officer, police officer or officer of customs or any other person acting under the direction of the Director-General, in the performance or execution of his duty or anything which he is authorised, empowered or required to do under this Act or the rules shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 12 months or to both."
As AVA did the prosecution, I think that might be why they went under this section instead of the one under the Penal Code which is usually handled by the police. For the act of obstruction, the section under the Penal Code is just one alternative that the authorities can consider as there are other Acts which also made obstruction an offence such as Section 137 of the Customs Act (obstructing a Customs officer) Section 57(1)(g) of the Immigration Act for obstructing an Immigration officer, Section 30 of the Misuse of drugs Act for obstructing a CNB officer etc depending who the person obstructed and the contraband involved.
