HONG KONG will not prosecute former High Court Judge
Michael Wong for alleged impropriety in connection with his
applications to the Government for reimbursement of Leave
Passage Allowance.----January 25, 2006
1. Former High Court Judge Michael Wong submitted the reimbursement claims of HK$280,000 for air tickets but was reimbursed
HK$170,000.
But at the time he made the claims,had not paid to aeroplane companies .
All the tickets ,
as he admitted to Ming Bao ,a HK Chinese Daily,that a rich man boy
friend of her daughter gave the 4 tickets to his family.2.The
Director of Public Prosecutions Grenville Cross accepted
that Michael Wong later return the equal amount of air
tickets to her daughter by paying her shopping.
3.THeir reasons not to prosecute:
In view of the sensitivity of the case, the nature of the evidence and the level of public concern, Mr Cross instructed Queen's Counsel Martin Wilson to consider the allegations and evidence, and provide an assessment.
Mr Wilson's advice was that the evidence did not rise above the level of suspicion and did not provide a reasonable prospect of conviction.
Mr Wilson advised Mr Cross that in seeking reimbursement from the Treasury, Mr Wong was making claims in respect of flights which he had taken and for which, in principle, he was entitled to seek appropriate reimbursement. To prosecute him successfully, it would be necessary to prove:
* Mr Wong did not, as claimed, make the reimbursement to his daughter;
* that when Mr Wong made the claims under the Leave Passage Allowance he knew he had neither repaid her, in cash or kind, nor intended to do so; and,
* that Mr Wong acted dishonestly.

Ming Bao raised few questions.This former judge dared to refuse meeting officers from
ICAC--Sg CPID.How came ICAC did not summon him?

which they had not actually paid for and do not declare
in the claim?
