last time when i just enter the airforce the sgt ever told me how his fren sue the gov when he got hearing problems due to work. he lost the case, gov argue that its always compulsory to have ear protection when you are at the flight line.

the government is prob indemnified in cases such as ns, else it would prob be flooded by lawsuits.

When PWD sued the Contractor for poor workmanship in building the CTE Tunnels - that resulted in water seepage - PWD lost after some months of trial.
The Contractor proved that every piece of the work was performed according to given design, materials used were sampled, tested and approved, and all documentations proved that the Contractor could not possibly have caused the seeping water due to negligence or poor workmanship.
There is hope when the suit is purely commercial, and does not involve Politics.
Note - the Contractor was a Joint-Venture company between a foreign and local firm. -

but im not sure whether its PWD u r refering to, or CPG - their corporatised and privatised incarnate. -
Made my enquiry this morning. Technically, the instructors can, and are, being brought up on criminal charges. In terms of a civil lawsuit, because the incident happened during training, the instructors will legally come under the aegis of the army, regardless of their breach of TSR. So the short answer is, no, the instructors, CCO or COA cannot be individually sued.

Hmmm.... Singapore got this type immunity for incidents happening during training...problem with this is army probably got immunity during wartime too (coz who is the judge to decide on tactical decisions?)- so IN MY OPINION effectively like blanket immunity ..KNN .wonder if other country got not.. singapore not welfare state, and responsibility for taking care of the elderly presumably fall to the children... therefore doesn't seem very fair to the family. Coz if can sue in civil law and get damages (cash), at least some compensation. Criminal law prob no compensation one. Hai- too bad got this policy- Sad sia. Now compensation probably only rests on insurance *if he has a policy* -
If this issue still *hot* during the run up to the next elections, dunno whether got politician dare to use reform of this law to campaign- my guess is not- and anyway politcs not within the scope of this message board
