I have been doing a lot of read ups and calling but not able to find an answer.
I am intending to go for a divorce with my wife. I need to have some advice I make any conclusive decision. At the same time, I wish to be anonymous as I do not wish to hurt my other half before any decision is made.
I will be grateful to know if I can retain my DBSS flat, which is less than a year, with my daughter if I go for a divorce. I had took HDB grants for the flat.
This is what I have gotten from HDB website;
"Under the HDB's prevailing policy for divorce (not due to non-consummation of marriage or annulment or break-up of Fiancé / Fiancée relationship), a divorced party who has the custody of the child (including care and control) is allowed to retain the flat subject to the eligibility conditions.
If there are no children from the marriage, the divorced party (flat owner) may retain the flat under the Single Singapore Citizen (SSC) Scheme, provided:
If the divorced owners wish to resell their flat in the open market, they must have completed the MOP for the flat, as at the date of divorce completion. If the divorce is within the MOP and none of the owners is eligible to retain the flat, the owners may have to return the flat to HDB, subject to HDB's approval. The compensation for the return of flat will be determined by HDB. "

Eligibity condition it means you must fall in either one of the criteria as stated by HDB.
From my understanding, you may retain your flat 1) under family scheme by adding in your daughter's name as a essential occupier. But that subject to either you have the sole custody or the care & control of your daughter after the divorce. 2) Under SSC scheme, but you must be 35 yo & above.

But you are lucky, Mr Khaw said that DBSS were built by HDB contractors...and you apply it at HDB office. Contridicting isn't it?
for less than a year, i do not think u meet the MOP aside to other considerations such as your age, citizenship status etc.
if u decide to divorce, both of u would likely return to the HDB (DBSS is somewhat a higher grade but still HDB)...
as for divorce maintenance, becos u r a man, u r still liable for the matrimonial fees..subject to your income....retaining your daughter? haha...boi boi...this is singapore...an unfair lopsided gender system....u can give her your last kiss and say goodbye...

if for some good reasons the custody of your children/s fall under you, hdb will likely to allow you to eligible to retain the flat… and now you need to get approval from the other party to agree, becos the other party also has a share on the flat.
if above are a bliss no problems, meaning surely the full custody and surely the other party approves you to have the flat, you can call HDB what to do.
if it is odds stacked against odds, i suggest you leave your flat to fate… hehehe…

How old is your daughter ?
She is giving up custody and parting the flat ? Was this decision made under duress ?
Why is your divorce contingent upon your ability to keep the flat ?
If you cannot keep the flat.. are you going to just remain married ? Or the more trendier term " Undivorced".
Unless she is already seeing someone.. and has short term plans to remarry.. it's best you seek counseling and try to salvage this marriage.
Take a short break from each other.. things may change.
I've several friends who got back together after few years of divorced life. Ironic.. not impossible. Pride was their biggest hurdle.

Why don't he just buy a 1 room or 2 room hdb flat?
or move in to stay with his relatives, parents or siblings?

Actually Park is good, i used to jog with my dogs at ECP after parking my car there, see lots of tents in the park, these peoples can enjoy a full unblock seaview, greener enviroment with garden and grasses and trees that look so serene to live in. It gives you a feeling of freedom and yet do not hv to face the walls of conrete and mosaic.
