Avoidable accident? Please read/comment

Dear all,
Today after 5 days of ownership of a brand new Honda Phantom 200, I met an accident. Here are the details of the accident.
I was with my wife travelling towards the AYE on the ECP at the extreme left lane, lane 4, on Wednesday morning the 8th of May 2002. As I am still running in my bike, 474 km total at the time of the crash, I was travelling at around 70km/h. As we were approaching the ERP gantry after Tanjong Rhu Flyover I noticed a black Toyota Corolla from lane 2, second right most lane, coming towards lane 3 in a 45 degrees angle.
The moment I realised that the vehicle is coming towards the lane that I am travelling, lane 4, I began to execute an emergency brake. We crashed around 5 to 10 meters before the gantry on lane 4 around 0910 hrs.
The driver claimed that he forgot to insert a cash card and wanted to stop at the shoulder, he also claimed that he was in a hurry to send his father-in-law to the hospital. I almost lost my cool and was close to using abusive language.
Both my wife and myself suffered abrasion and bruises. Total damage to my bike is around S$450/-, I am in the process to claim insurance from him. But in retrospect I canÂ’t help but assume that I could have avoided the accident.
Any comments/advise? -
was there a collision between the both of you?
the accident could be avoided in 2 ways, 1 of which would be to speed up. the other of which is to brake while going towards the shoulder lane.
eitherway, if there was a collision, he is at fault.

Yes we collided. He refused to commit in a compensation. In fact he is attempting to shift the blame to me. Stating something like my head lights were not on, I was speeding, something on that line.

Maybe you can tell us what happen next and what is your action?? I will like to know what you did so that if i am in the situation, i wont panic or kan chong!!!

I collected the details of the driver. Licence number, make and model of vehicle, address, contact number.
I should have done the following.
1) Stay focused and not loose cool
2) Take photographs
3) Get passerbys to help as witness -
The most impt thing is to report to the police, then you have yourself covered. If you wanna claim insurance, you would need the police report... if the stupid guy dun want to pay, you at least have the police report to go claim your insurance...
Better play safe...

1) Government vehicel or damage to government property
2) foregin vehicle
3) Pedestrian or cyclist
3i) at least one party hospitalised
3ii)MC/hospitalised for more than 3 days
4) Hit and run
My case did not meet any of the above -
I should have done the following.
1) Stay focused and not loose cool
personally, i think souldnt be too cool, esp if u know he more wrong than u. of coz, not until vulgarity and threatening behaviour from u. wat i mean is if u appear too kool, this other person might take it as a sign of doubt on your part, and might see it as an opening to insist u were at fault. some ppl like dat i guess, and like u mentioned, the other guy did try to lay blame on you. i stress i dont think shd start until vulgarity all come out of coz.
some more, in a hurry to bring father to hospital, then got time to stop and put cash card meh? if the father such critical condition he would rather pay that little bit extra for no cashcard wat, unless his father's life worth less than the small little fine.
2) Take photographs
good idea. but we dont all carry camera wif us everywhere we go

3) Get passerbys to help as witness
oso good idea, but i find s'porean very 'cant be bothered' and very 'dont wanna get involved'.
and, about whether can be avoided, personally i think, if you on bike: all accidents can possibly be avoided, but you cannot possibly avoid all accidents. heh heh does it sound too cheem? i guess i accept i as rider bound to meet accident now and then, but i keep faith as long as i dont look for it, the ones i get into wont be serious. all heng-suay of coz.

You don't need all this. If one party is injured, you will need a police report to claim insurance. no need to talk so much, ask for his name, ic number and contact number. also jote down his license place number, time of accident and location.
if he refuse to pass u his ic, name and contact number, using his license plate, go LTA and get his details, then make a police report, coz there are injuries involved, then claim against his insurance company. -

cos my frend got hit by a van b4 n it was de van fault but de van driver made a police report 1st n de police call him down
n Now is difficult for him cos de van driver putting de blame on my frend for stay in his blind spot , de accident happen while de driver was making a turn .
N my frend did not even ask for anything name , ic , lincence blah blah

to submit a claim, u need not have not report as ur case is not in any of the catergory u mention,
this is wad the police at tampines NPC told me too
u can submit a claim and also lodge a report against him, better still u shld have call the police on the spot, this type of pple deserve no mercy
n his blah blah crap abt his cash card, if he had seen the news he is not suppose to stop on the rd shoulder, by rite, ur not suppose to stop on the rd shoulder except veh breakdown,but i think still can close one eye if ur on the phone
n his dad in law. haha if hes rushing, wad for stop in the 1st place, this type of pple dun give mercy
n u shld have let ur feelings out, remeber,he could have done more harm to u and ur wife
and regarding the insurance part, ask him to pay cash, coz insurance claim usually are months-long affair and they will get their surveyor and blah so on,remind him, ask him if he know anything on N.C.B (no-claim-bonus)
ask him to calculate if his premium for next yr is better or worse
finally,whether this thing can be avoided depends on situation, if hes really making an adrupt lane change then cannot blame u also, if it can be avoided, i think u would have avoided already rite?

sorry to hear abt your accident.
here are a few points
1) you DID notice him at lane 2 cutting into lane 3 den subsequently into lane 4 where the 2 of u collided. i assume he was cutting traffic recklessly and at a high speed or else u would have been able to avoid him, which means you DID notice him but could not react in time due to (this is the important bit) the fact that he was RECKLESS or SPEEDING. DO NOT LET HIM TURN THE TABLES ON U BY SAYING U WERE THE ONE SPEEDING. hit him before he hits u!
2) he claimed to be cutting into lane 4 or shoulder to insert his cashcard, granted he has difficulty reaching his cashcard or inserting it. this is verbal evidence and witnessed by your wife, that it was his intention to cut to the shoulder before the gantry, recklessly if need be. use this in the report, bcos if he had no need to cut into shuolder, there would have been no accident.
3) there is a possibility u were in his blindspot, but remember that it is not a crime to be in another vehicles blind spot. yeah try to avoid being there but these things happen everyday. it is his duty to check his blind spot before lane changing... wat more across 2 lanes on the expressway. if he DID check his blindspot, den it is also evident that either he was speeding or you were speeding.
to recap: he was RECKLESS or SPEEDING, his intentions were to stop by shoulder before gantry (recklessly if necessary), he did not check blind spot and u were 2 lanes away (further evidence he was reckless and speeding).
remember it is highly possible he could counter attack by saying u were the party that was speeding on lane 4, which u can defend by stating his lane switching from lane 2 to 4 in such short a time. -

Just to update everyone. I have just returned from submitting a 3rd party insurance claim against him. NTUC insurance. They told me that the paperwork might take about 2 to 3 weeks to be completely processed.
Honestly my heart still hurts whenever I see my wife limping around. I am making a mental note not to become "physical" if I ever meet him.
On a personal note I would like to say that I really don't believe in "luck". I feel that almost everything in life largely rest in your hands.
Thanks for all of your well wishers. In the future if I ever witness an accident I would not hesitate to volunteer my services. Hope you would do likewise.

u were on the left lane when u knocked onto him??? so did u knock onto his rear or side?
or did he knock onto u? if u knocked into his rear end then i think there will be some problems. -

Don't worry, the bloody driver has no grounds for claiming that u were in his blind spot and that u were speeding
1) Every road user is expected to check blind spot and mirrors b4 doing anything and to drive carefully to avoid endangering the lives of other road users. Emergency or not that is no excuse for cutting sharply across 3 lanes at high speed. Not to mention that no amount of checking is going to prevent an accident when he trys to pull off such a reckless stunt
2) That u and your wife suffered only minor scratches despite colliding with another vehicle on an expressway is evidence enough that u were not speeding. You also need much longer braking distance when carrying a pillion. That u were in the left most lane ( the slowest lane ) is another advantage
If your case like that also cannot claim insurance then the whole system is really fucked up...

Thank you so much for your assuring post! The Surveyor was taking photographs of my motorbike yesterday.
