Precept can be divided into four: Open, Protect, Hold & Violate.
When it's time to open, and you don't open; and when it's time to protect, you don't protect, you are breaking the Precept.
Precept/Vinaya is benefiting oneself and others altogether.

'Open & protect' is language use by Vinaya School to mean during one's immediate upholding of precepts, there's times when upholding can be loosenly allow and there's time when it's strict.
Uphold is divided into 'Preventive/desist' and 'Performing/Act'.
1) Safeguard the 5 precept and other precepts etc while desist from evil/unwholesome act/karma of body, speech and intentions, is known as 'Preventive'.
2) During the quiet period of repenting and tolerance and safeguard ones purity, by controlling ones greed, anger and folly, is known as 'Performing/Act' of upholding.
'Violate' is also divided into 'Preventive/desist' and 'Perform/Act'.
3) Due to the act of greed, anger and folly, one violates the regulation of (1) is known as 'Act' of violation.
4) Negligent of the act of greed, anger and folly, one violates the regulation of (2) is known as 'Desist' of violation.
