Anyone who died, and did not sign the form opting themselves out of the HOTA (Human Organ Transplant Act), is eligible for organ donation provided, their condition prior to death renders organ harvesting feasible, ie. they must be 'good candidates' for organ harvesting. Different bodies react differently to the same substance. One person being able to 'survive' through years of smoking does not conclusively prove that everyone will have the same outcome, and vice versa. What we can do, is look at the statistics, and that will make the situation glaringly obvious.
