The Japanese companies have to request for the court order themselves, and that means getting publicly involved either by making it official or sending a representative. This is both time consuming and costly, and the press will probably cover it as well in Japan. It's not the kind of PR the companies want.
On top of that, how are companies like Bandai going to answer when asked why Bandai USA is supportive of (or at least, neutral to) fansubs in the US but cracking down on them here? Is it because Bandai USA spoke on behalf of the fan community there, whereas their representative here (Odex) painted a negative pictre just so to explain away their poor sales? I hope this isn't true, cos that would speak volumes of Odex's "commitment" to fans here.
