V (a gal) lived with her boyfriend and D (a guy) was staying with them. V and D were testing out some wines and were drunk one night. V claimed that during the night, she was awaken by D getting into her bed and touching her. She thought it was her boyfriend and D and V had intercourse. When V realised D was not her boyfriend, she punched him. D was charged with rape, but claimed that V consented, even when she knew who he was.

More importantly, with one-night-stands and pick-ups from bars where alcohol is served becoming common, how do guys stay within the boundaries of law and prevent your gal-friend from crying rape the act after.

she is not drunk. he did not force her. it can't be a rape case.

of course he can always claim that the gal was a consenting party, not drunk, loose gal....The fact that she had pre-marital sex wif boyfriend, stay in a single flat with 2 males etc....how to quantify her morality and the truefulness of her claims??
So as always....
It really depend on how well both parties present their cases..though i must say tat spore legal system tend to protect the female....
Either way its a painful exercise for the female....

guess its how well the female can convince that she believed thru-out its her bf bah but even so i think its shaky since no attempt by the guy to bluff evidenced.
you meet a guy near your house who looks exactly like your bf then you go and have sex with him without confirming or indicating that you think he is your bf how to blame the guy? -
Whether its rape or not i not sure. But one thing for sure is that the law in Singapore always protects the women

there's really this law that say,if the gal had sex believing that its his husband or bf,then in the later part know that he is not.the consent is not a consent
fyi,even if a couple have sex in halfway,if the gal suddenly wanna stop but the guy insist of continue & not stopping.the gal can report him as rape too even they are couple.. -

Anyway, would the female involved be penalised for putting up a false case? Else, I would see somehow a possible fault in the law system...?
From what I know, in order for them to encourage rape victims to step forward, they probably have decided not to impose penalty for such a case being dismissed. However, just like in almost any possible systems, there bound to be people drilling into the 'holes'... The court probably won't hold it against the female party so long as she's not making an aggressive attempts to sue many different guys for 'rape' in failed attempts..? -
RAPE. Cuz V was under the influence of alcohol.And V did not say yes to D. She meant yes to the boyfriend and since D aint no boyfriend, it's RAPE.
