I get into trouble... advise please

Since young I have phobia in driving (was having bad experience when I was really young).
Last year, I enrolled to BBDC. And I've been stuck in theory, just because I still could not overcome my phobia. I booked the practice lessons several times, but cancel it when the date is drawing nearer.
Trying to help me overcome the phobia, my bf allow me to sit at driver seat. I was really scare and dare not touch the devices as I worried that the car might move. He assured me that the car won't move as the hand break was up. He told me to try to adjust my seat, mirror, play around with the light & wiper, step on the clutch and foot-break.
I was hesitate at first until he demostrated playing with the gear and asked me to press the clutch. But my luck was really down, the TP came and took our particulars.
A month later, I was asked to go to their HQ for interview... separately from my bf. I told the story from beginning till the end and I told nothing but the truth. Then the TP, force me to admit that I'm driving (the car is moving) by keep repeating the same question and threaten me that if I continue to be so stubborn... he will drag me to court. I'm a very timid person in nature, and was really scared and don't know what to do. He assured me that if I admit, the worst scenario is just a fine case as it is just a very small and minor issue. But if i continue to persist on my true story, the problem will blow-up and they will charge me to court.
Foolish me, admitted that the car is moving despite it is not moving. And now, I receive a court letter with likelihood charges of licence being revoked (for my bf), fine $2000 each of us and / or 3 days imprisonment.
I'm worried sick and dunno what to do. Please advise me on this anyone...

I dont know about the success rate of winning your case versus the government(traffic police).. any lawyers here want to give advise ? -
I'm really at lost now... my bf really can't afford to lose his licence, he need to foot his father medical expenses.

the letter of fine from court should also indicate a court date. if not, make your way to subordinate courts located at Havelock road and lodge a complaint with the magistrate on duty. there is only one way to get outta the situation now. fight the case in court. go to the judge that day and tell him the truth on this matter (u have to swear to tell the truth before you begin speaking anyway).
if he buys your story (which i think holds some water knowing that there are indeed some unscrupulous IOs out there), than he'll fix dates for your case to go on trial for the IO's inappropriate actions in forcing a confession outta you.
pros: if you win, u and ur bf dun have to live with the fine and a record with the tp which will prevent u from driving for some time.
cons: u'll have to spend money to engage a counsel to fight your case for you in court or die die use ur words against the officer of the case in court (not advisable since you mentioned that u are timid). u may still lose the case and end up paying more for the lawyers fees.
its a mistake on your part as much as the police IO's to have succumbed to the threats. it would have been much easier to prove in court that the car wasn't moving at time of the alleged offence in the first place than to prove now that the IO had forced u into signing the statement. nobody should be coerced into signing a statement which they do not believe to be the truth.

thanks so much driftingguys & tailslide... the court letter do indicate the hearing date. And I dare to swear that I'm telling the truth and that my case is genuine.
Should I engage a lawyer first or should I wait for the court verdict?

yup...and if the procecutor ask you to answer only the questions he asked, ignored him and tell the judge that in order to speak the truth, you need to tell the whole story as the procecutor may be distorting the truth!
remember that...cuz procecutor also force u into a corner and make like you are at fault, dun give in to them.

Write a appeal letter before the date for u to turn up on court. Tell them yr situtation and if u remember which officer threaten you, rite down his name and mention in the letter.. it will helps alot and they will investigate on the officer.
Do not be afraid of telling them the truth. -

I have a friend in the same situation as you B4 and also just letting his friend learning to park in marina south carpark. Worse still he was caught by a off duty TP. He admit to the charges and was fine $1000 and suspension of his license for a year and the same for his friend. There should not have any Jail sentence unless you are not an first offender.
I would not advise hiring a lawyer unless you have a VERY VERY strong case if not the only thing they(lawyer) would do is to charge you for the court proceeding and plead guilty on your behalf.
Especially you and your BF have given your statement and it would not be an advantage to your case. Based on what I have read from here.

My bf and I believe that someone must be complaining about us playing with the lights...
The location whereby the TP spotted us is at those quiet place & seldom have cars... We don't realize that there are few couples around as the place very quiet and probably because I'm too focus. We might have cause disturbance to them and hence the complaint to TP...

lawyers need time to study ur case (they are paid *lots* to do it anyway) before they can put up a good representation 4 u.
if u already have a court hearing date, juz go see a lawyer about it. he will be in a position to advise u there after on what to do on the actual day, including what to say when u are asked certain questions blah blah blah blah. so suggest u get to it a.s.a.p
dun need to write letter of appeal or what unless u getting your MP or what to write something to support your character in this case. otherwise such letters are useless in a court of law as you will have to take the stand to answer the charges anyway. -

Go to the police station and lodge a police report against the IO, then do what tailslide asked you to do. If you think that the police officer is abusing him powers. This is not within the power of a MP well unless your MP happens to be minister of internal affairs. Since it is already a court summon it is highly unlikely that the police will take out the charges against you by merely the words of a MP.
Use of words is very important in any case, and you may have misunderstood the IO's meaning of forcing you into admission. He can only advise you on the charges and give recommendation. If he goes beyond his power like forcing you to sign it will be abusive of power. This is highly unlikely to happen in Singapore however, there are always black sheeps among every organisations.
Assisting or driving without a licences will have a charge varying from fines to imprisonment. A suspension on driving will also be impose for the two of you if both are to be found guilty.

At this point of time, i can only go and seek MP (i dunno how he can help as well and i actually agree that certain things are beyond MP control)... but I will try all possibility...

TP now damn on the ball, they sure suspend the licence and fine u all guys.
u can engage a lawyer and help out loh... and get a psycharist to certify your phobia...

seriously i feel that since the car is not moving, then it shouldn't be so serious, as theoretically you ain't considered to be driving. i don't know abt the law, maybe they can say that since the engine is on, then you pose a danger to not just yourself and the other road users. in fact you shouldn't have been taken in by the TP IO, should have taken a strong stand on the truth. so at least still can argue abt you not moving the car at all, and have no intention at all to do so. perhaps you can tell all these to your MP, and be as humble & innocent as possible.

try saying that u din have the idea to drive and was juz trying shift the gear to familiarise with it. as the handbrake was not up the car did or did not move by a little when u try to depress the clutch down u not sure. but under the pressing for statement and the two ways the police gave u as the minor fine or charging,u admited the car did move, but it was not as u were stepping on gas but only rolling due to uneven road.

it is nothing new under the sun that IOs are known to use hard tactic to coerce for a confession.
i have seen many IOs getting into trouble...many whom have been sacked......
no need to engage lawyer and waste your money ok...i am telling the truth..some Singapore lawyers are known to be plead-guilty-lawyers.....they will encourage you to admit to your 'crime' and their job is to mitigate for u and appeal for lighter punishment.....
maintain your stand....see if Suba - the criminal lawyer - can help you free of charge.....he had several heart attacks but survived....and still surviving...
it is a serious offence for IOs to coerce you into making a false admission...

the car was not moving? where are you in the first place? if TP was around.. you probably are driving the car.. case close... as long as the car is moving and you are the driver even in the carpark it is driving without license...

Not carpark, just a secluded place, maybe a park or something.
Anyway, for this case, I think the best is still the lawyer, can ask him to appeal for leniency. I guess the fault is yours, cause how are you going to prove the car isn't moving. TP can always argue your BF pull the handbrake when he approaches. The case is super-against you, plus the fact that you actually admit it in the first place. What to do, cause it is serious to drive without license.
Singapore's law, guilty until proven otherwise. Don't if true a not???
