And turning off the stability control in crowded traffic to 'test the handling' of the car is not a wise choice. And no one really regulates roll-over protection because well, the majority of accidents are frontal and back collisions.. crumple zones were designed for front and back collisions.. No one really expects a car to roll.

I'm quite sure Mazda launched its new MX5 a few months back. I have driven through that metal platings there before during rainy days and I found my car (an FR) tail-fishing when I jammed the accelerator (ESP was activated so nothing happened).
You should consider if such an incident would happen had the driver swerved his car on ashpalt instead of metal plating.

However, SpoonX already stated that the driver did not speed and currently SpoonX's statement is the most reliable among all the different hypothesis considering he is related to the driver. If not speeding even swerved on asphpalt will not have that much impact. Yep a whole bunch of excuse is given in the end what ever factor say, he still make one mistake that is speeding.

Let's respect his claim that the driver did not speed unless you can come up with a more concrete evidence that the driver was actually speeding.
Well it depends on the situation for me. The instinct to swerve would have been more overwhelming if the object of obstruction is of close proximity. This is a freak accident and I believe it has got nothing to do with the car designs, engineering or its roll-over protection. Miata is no a new car, and I doubt it could survive for so many years if their safety feature are not properly designed. For this case with or without the roll protection the passenge will not be able to survive head on size impact from the BMW.
