The clutch is usually abused by renters of the vehicles and is likely to be the cause of that burnt smell. No, you should not pay. They should be thankful that you did not claim from them for loss of usage.Originally posted by asen:Hi everyone, I need some advise from you all.
I'm 19 this year and just passed my license 4 months ago. I rented with this car rental company with good experiences 2 times ago. But my 3rd time was bad.
They gave me this lancer and after a few hours of driving, the transmission gave way. This is my story.
I was running around 70+km/h and was approaching the traffic light which was turning to red. I did engine breaking from 3rd gear to 2nd gear. But upon down shifting to 2nd gear, there was a loud pop sound followed by a burned smell. I knew something bad has happened. When the light turned green, I tried to pick up with all the gears but I'm only rolling slowly. So I stopped the vehicle and took a look at the engine bay. No smoke but just burn smell. So I called their 24hr Help line and got the car towed to the workshop, and got me another car. I asked if i'm liable for the damage, they say we talk the next day.
The next day when I returned the car, they told me that I have to share half of the repair cost with them. I don't think is fair to pay as I'm just doing normal driving and the tranny gave way. I'm not speeding or whatever so.
So what are your opinions? Please share.. Thanks!
*Is Mitsubishi tranny weak? I heard that their tranny is prone to get damage easily..
Probably this is what the thread-starter got to do.Originally posted by pilotsnoopy:most probably do not have to pay...read e documents you signed with them again...and you would probably know your rights better...
if they are a proper rental company, they will have the vehicle covered with the proper insurance and do not have to 'claim' from you no matter what amount, but if its a private vehicle they rented to you without the proper insurance...you can even threaten to report them to LTA...
Agree! Don't pay what they said... It's not justified...Originally posted by drumstick:Burn smell...
If you are changeing gear with proper procedure and not doing half clucth accelration... how did you get clutch burn.
This is a rental vehicle, it happen due to malfunction and not due to accident.
You should tell the rental company you demand a refund for the incovenience it has caused you for being unable to use the car. Dun pay them.
Remember....its a malfunction and not cause by accident. If they still die die ask you to pay... tell them.. "wait for my lawyer letter"... lolz...
If they threaten you even the rental agreement doesn't have any clause, report them to police for case of threatening, and bring your case to file a complaint at the Magistrate Court should they harass you for harassment...Originally posted by Eragon:Take a good look at the rental agreement u have signed.
Any clause suggesting your must pay half? If no, then u can bo chap them.
Obviously do not pay!!Originally posted by asen:The car is from a rental company. The smell was from the gearbox, and the whole gearbox has now been replaced.
I didn't know their terms and conditions.. Now I've check and read about them. One of them is..
- The said vehicle shall be covered under a vehicle insurance policy. But does not coever damage/ missing/ stolen item.
So what's my chances? I've yet to talk to them as was busy with work. My cousin told me that this should be malfunction or wear and tear. So it is not my responsibility to pay for the damage.
I'm so lost.. No idea with CASE or LTA can help me? Or is better to settle by myself? Thank you for the advices! Greatly appreciated.
the t&c u mentioned not relevent to the damage of the car. so i guess they could claim from their 3rd party insurance.Originally posted by asen:The car is from a rental company. The smell was from the gearbox, and the whole gearbox has now been replaced.

The rented car that you've driven is not by any default damage, thus causing the overhaul of the gearbox, most likely scenario is due to wear and tear... And for most cars, the cars are insured and the rental company can file a claim with the insurance company... You don't need to pay...Originally posted by asen:The car is from a rental company.
