a van stopped head on at the end of a petrol kiosk which was just beside the exit of the kiosk.
upon leaving the van reversed and a vehicle came in from the exit, causing the van to hit the vehicle by the side.
who's fault should this be? -

The issue is... the van can always say he (or she) din reverse!!!
At petrol kiosk there may have cctv. try ask for it. -

Both vehicles have to share 50-50 blame, van make mistake, the other vehicle saw it but don't stop.
Same case on the roads, you see a vehicle obstructing the lane in front of you, yet you don't stop or avoid when you have the time to.

Depends on many other factors as well lor like wind direction, wind speed, visibility, eyesight of both drivers, people in and around the area...... even humidity.
