why drive car cannot use hp but can smoke?

holding the hp n talking while driving is illegal....
but why there is not law regarding smoking while driving? coz when smoke also need to use one hand to hold the cigarette.... -

Smoking is bad for health, but it doesn't affect thinking ability..so even though only one hand left to drive, still not as dangerous as talking on phone..
Talking on phone means using half of your brainpower to talk, and left only half of your brainpower for driving..hence it's dangerous because you are not as concentrated..
