advices needed

i got a friend who order his car about 3 months back. The estimated delivery time stated on the paper was Sept/Oct. The problem is now the car might not even be able to deliver to my friend this month. The agent said to confiscate the downpayment if he decides to back out now and also need to buy over the COE that was successfully bidded in his name.
Need some advice..If my friend decided to back out after OCT, his downpayment will still be void? Its the company fault as they did not honour their promise to deliver the car... -

wat i can suggest is....
make a fuss n complain to the management level...
how cum they cant deliver by the expected date??? -
Not sure about legal issues but I would definitely sue the agent if he cannot deliver by Oct and refuses to refund my deposit. This is a terrible position your friend is in, especially with COE prices like that. Hope experts here help out lah... -
check the statement they make to u as "agreement letter or form see wat is inside if the date given u stillhaven get the car go to minstry of something due with purchase and sell and make a complaint u call them first to threaten them see wat they going to do then if they say go ahead they u go complaint.haiz...y buy car dun look for me.....

Is there by any chance that you fren did not wan to confirm the COE bidding so as to save a few hundred bucks? Onf od my frens did tat and his delivery date was drag from SFF to SFH. That means a total of additional 2 mths.
If it turn out to be likewise then maybe put the case up to CASE. They shld be able to help ur fren further.

Since your fren has successfully bidded for the COE and paper states that he should be receiving by this month, than he has the favour of winning this "case". Ask your fren to go screw that agent of his.. Go tell him that he has bidded and got the COE and paper indicates that he should receive the car by this mth..
There is no such thing as forefit... If he insist on one, you can bring matters to court.. Where the court, will in this case go in favour of you.. Due to the reasons and evidence that is present... I have not heard in my life where a downpayment is forfitted if a buyer wishes to back out due to valid reasons like the one you mentioned above.
