Aren't .exe files the only compulsory file that require virus scanning? Try wrapping the files in .zip or .rar archives.
If you tried to send any executable files via MSN (.EXE, .BAT, .CMD, .COM, .PIF, etc), MSN will prompt you to install the virus scanner. It cannot be turned off once turned on.

That one is for your antivirus program. The one that comes with MSN can't be disabled. But I think it does appear in Add/Remove Programs. You can try uninstalling that and it maybe disabled from there.
