I wonder why certain states in the US get to abolish the death penalty while others don't. It's a country as a whole, shouldn't they uphold the same legislation?

US has 2 sets of legislations.... state law and federal law...
criminal legislation falls under state law, not federal law...
hence, the individual states set the punishment... -
