[News] Man behind taxi hijack at AP gets 25 months' jail

SINGAPORE - A 31-year-old man who hijacked a taxi at Changi Airport's budget terminal and ran over a cleaning supervisor was sentenced to 25 months in jail on Monday.
SINGAPORE - A man died on Saturday morning after he was hit by a hijacked taxi at the driveway in front of the Budget Terminal.
The 34-year-old Indian man, Mr Chandra Mogan, a cleaner on duty at the airport, was pronounced dead at the scene by paramedics at 7.13am.
The police received a call at about 6.50am regarding an assault by a 30-year-old Chinese national passenger on a 57-year-old taxi driver along the stretch of Airport Boulevard in front of SATS In-flight Catering Centre 1.
The passenger, who was headed for Changi Airport, started getting violent towards taxi driver Yeow Chuwee Lam during the journey, said a statement released by Comfort Delgro.
The taxi driver later activated the distress button and got out of the cab.
According to Comfort Delgro spokesperson Tammy Tan, the passenger had also stepped out and allegedly started to attack the driver.
Police said the passenger was later seen taking over the wheel and driving the taxi towards the direction of the Budget Terminal.
The taxi hit Mr Mogan along the driveway of the terminal and smashed into a glass side door next to McDonald's. A traffic light was also badly damaged.

Even question the judge? Judge Chay Yuen Fatt is 1 of the fairest judges on the Sub Courts bench.
So many charges? Well lets see, if you are charged with multiple offences, the Court will in most cases sentence you on the 2 most serious ones, with the rest TIC.
The 2 most serious here:
1) Theft of Motor-vehicle
2) Rash driving causing death.
The rest all consider minor in terms of sentencing.
Sentencing norms for vehicle theft: 18 months (minimum)
Rash driving resulting in death: 6 months (minimum), I wrote 8 weeks earlier that is for death resulting from careless driving, not reckless
He got 25 months. You consider this light? Perhaps, but did you know he suffering from paranoid schizophrenia?
Lawyer from Subhas Anandan firm? Yes, free legal service, all lawyers register for pro-bono (free), and cases are assigned by turn and ability/availability of lawyers to defend.

This is not murder, attempted murder or whatever charge you think of. This is not hijacking either, that's a press term.
Was this sentence fair? Yes, it was also strict. You got try live in jail for 2 years.
Would a Singaporean get the same? Perhaps but unlikely unless the person was similarly mentally ill.

Force possession? You mean robbery, I dont think the facts support a charge of robbery, the man got crazy hit the driver who abandoned the cab, which was driven away.
He did not enter the cab in order to rob the driver of it.
The sentencing norms were followed in this case. Judge Chay, I've seen him in action, a compassionate judge who judges each case on it's merits.

As said it depends on the charge, if a cabby or anyone else punced a car driver in order to relieve him of possession of his vehicle, that becomes robbery with hurt minimum 5 years + strkes.
But you punch a driver who runs away and then you drive off in his car, like this case, that's only theft of vehicle. Minimum usually 18 months, usually 2 years for that.
Causing death by rash driving, the maximum raised from 2 to 5 years. Sentence depends on the facts of the case, if like the Ferrarri driver, driving at that speed and over such a long distance, can expect sentencing to start around the 30 month mark.
Normal cases: 8 weeks to 6 months, depending on the facts

If just say for figure of speech, we take a normal person whack a driver near the airport, take his car and committed the same act this Chinaman did, then can expect a sentence around this:
379A - 18 months
RTA offence - 24 months
Total 42 months or maybe slightly lesser, say 36 months.

At least 5 years (because 2 deaths)
2 years for 379A + 3 for the RTA, or sometimes in certain cases, they proceed on 3, so can be 2 + 3 + 3 = 8 years, if drunk, the 3 year figure ( for RTA) can go to 4.

but sometime you read those penis code, they did stated last ammendment is when.......
maybe they need more time to change?.......
