Can you ascertain the fact that it's the driver's fault in the first place? Put yourself in the driver's seat, its a green light, you go for it, pedestrian comes out of nowhere, you hit him, your fault? there are also drivers who see that it is red light, know they might hit someone, but go ahead anyway. And in the end, he really did hit someone, but he knows that he has the power and backing or money to shut the police officer up, and he really did get away scot free.
