Can u sue a person who doesnt have money?

  u r just wasting money on legal fees...they dont need to go jail...just declare bankrupt

  Depends on the case involved and the judge's ruling.
  
  If it's not just out to thrash someone, but more for some gain backs or benefits.. I say "Don't bother..."
