Elements of Defamation
There are three elements that need to be established by a plaintiff claiming defamation:
-That the statement made was defamatory
-That the statement referred to the plaintiff
-That the statement was published
The test for whether the statement made was defamatory is to query whether, in the estimation of right-thinking members of society, the alleged statement would lower the reputation of the person who is the subject of the statement.
Statement must refer to the Plaintiff
The defamatory statement must make some reference to the plaintiff. The fact that the defendant did not intend to refer to the plaintiff is irrelevant. It is sufficient if people who knew the plaintiff knew that he was the one being referred to
Statement was published
Publication means making the statement known to any 3rd party, i.e. someone besides the plaintiff or the defendant
To answer your question , as long as the people who knew the person knew that u were referring to him , element 2 would be satisfied.
Based on the above elements , you would be liable for Libel , defamation in printed form.
