Sometimes some people shouldn't go to jail

I have read some months ago in the newspaper ... father sentenced 2 and half years to jail for caned severe son, maid jailed 3 years for pulling off the ear of an elderly woman in her care.
are those sentenced completed or on probation??
Caned your son severe , or maid pulling off the eard of a woman , is wrong , but IMO some weeks on jail is enough , but jailed them 2 or 3 years is disproportionated.
Stricts laws for big criminals is ok , and sometimes they have chances , but for non criminals who make some mistakes like pull ear or cane sons , they shouldn't be jailed for long time.
but i don't know if those sentenced are take on probation , like some people who violated copyright on the net are sentenced to jail but on probation.(they are not sent to jail) -
Can I pull off your ear or cane you serverely until your buttock see the bones? Law has its use for deterance too.... not just punishment. The main use of law is to stop future crime for happening....

the old chief justice is gone liao .... under that chap one can expect no mercy ... if you appeal you may find your sentenced increased ......
who knows ... we may yet find a little more humanity in the courts now .....
but NOT for drug traffickers and such !!! ...
