Odex dint win though, the appeal was rejected but names are supposed to be revealed by Pacnet to the 6 Japanese Anime distributors instead.

Court rejects Odex's appeal to reveal downloaders' names

SINGAPORE: Anime distributor Odex Tuesday lost its appeal to the Singapore High Court to force internet service provider Pacific Internet (PacNet) to reveal the names of its subscribers suspected of downloading anime clips illegally.
The appeal was dismissed on the grounds that Odex is just a sub-licensee but not the copyright owner or the exclusive licensee.
Instead, the courts ordered PacNet to hand over the information to the six Japanese companies, Sunrise Inc., Kadokawa Pictures Inc., GDH K.K., TV Tokyo Medianet Inc., Yomiuri Telecasting Corporation and Showgate Inc., which actually own the copyrights.
The ruling has paved way for further enforcement actions by other copyright owners.
Odex said it will work closely with other copyright owners, which are expected to make similar applications to court soon.
The Odex case has seen much interest from the public, especially in online chatrooms and blogs. Many were unhappy last year when Odex forced StarHub and Singtel to reveal the names of those suspected of illegally downloading anime clips. - CNA/ac

Does it matter? PacNet still has to reveal the names. And worse, to people who are not locals!!! ![]()
What kind of details will be released? I'm not in favour of this ruling at all. Much as we have no privacy laws here, it doesn't mean they can be released this way. This is absurd.

Theres no way out right from the start seriously, there's no way that this issue could be solved harmoniously.
But its just ridiculous that after nearly half a year, this issue is still floating around.
I agree though, ISPs giving out our private information, no matter if you are a violater of anime rights or something else, it just isnt right in all sense.
But theres nothing that we can really do here in SG either.

If information is going to be released to the Japanese distributors, good luck to PacNet users. One wonders if fighting this case is really worth it. Singnet gave up without a fight, didn't lose much. Starhub fight and lose to ODEX, fair enough. PacNet fought and lose, with no telling of what will happen to the users.
Sigh.

Who cares about the social implications? Its such issues that affect the minority of people too, and the general population have a non-chalent attitude; People dont want to touch it unless they are personally involved.
Its reality mixed together with a tinge of sadness.

Usually, people watch the first few episodes of an anime to determine if he/she likes it or not. Without the 'free' sampling from the net, I suspect the anime-following crowd in Singapore will diminish in size.
In the end, ODEX will just be shrinking their client base, alienating potential customers too.It's like a dying animal putting up one last struggle.

Because of this saga, nowadays I started to lose interest in anime though I still watch some interesting once (2 or 3 anime).
Anyway, I say those who paid for the VOD can kiss it goodbye. Its been months since the website is down and best of all, no news about it at all.
In the end, I say both sides (odex and the consumer) suffer from this saga.
We download illegally, they don't earn anything. We stop downloading, they also don't earn anything. Now, most of us go online watch, they also don't earn anything. Its a meaningless battle.

Illegal anime downloaders are not off the hook
ANIME distributor Odex will not be
getting its hands on the names of
customers who had allegedly
downloaded animated Japanese
cartoons.
Its suit was dismissed by the High
Court yesterday, The Straits Times
reported.
Odex had attempted to obtain the
names of the PacNet (previously called
Pacific Internet) customers who had
allegedly downloaded the anime.
Instead, the High Court ordered the
Internet service provider to reveal their
identities to six Japanese anime studios.
In a verbal judgment in the High
Court, Justice Woo Bih Li said that since
Odex could not sue downloaders under
Singapore’s Copyright Act, there was no
reason it should be allowed to obtain the
names of the alleged downloaders.
This is the same reason District Judge
Ernest Lau had given for turning down
Odex’s request for the names last
September.
Odex had appealed the decision, and
had subsequently made submissions to
add six Japanese anime studios to its
case.
Justice Woo granted this request.
Since these studios owned the
copyright to the animes and could sue,
they will have access to the downloaders’
names, he said.

ODEX can't sue, the international businesses can. One complain from them, straight away you are being monitored. If the amount you download is huge enough, your house will be raided the next day.
Worse if you are downloading, uploading and selling them off for a profits.
That's how music and movie downloaders are caught. Just because it's not licensed here, it doesn't mean you won't be caught. Also, just because we are slower to give out licenses, it doesn't mean that you won't be caught either.
So long as it's proven that you are infringing copyright laws, they will still catch and see you in courts.

I hope PACNET will carry-on the fight. There is something not right with this judgement and hope they can pick it up. Maybe their US counterparts can prove a stronger case of privacy protection.
now that the names and details are in the japanese hands, i dont think they will be taking such extreme action like odex.
cos no one can be their scapegoat if they decided to take action.
