Ipoh woman sues him for dumping her
August 29, 2007
WHEN Ms S Nagamah's boyfriend refused to take her as his bride, she took an unusual form of revenge - she sued him. And won.
Yesterday, an Ipoh High Court awarded the woman RM87,000 ($38,000) because her partner had broken his promise to marry her.
The Star reported that Justice Mohd Azman Husin ruled that the 38-year-old legal clerk had proven her claim against legal office administrator R Punnosamy, 41.
Ms Nagamah had testified last year that she had sex with Mr Punnosamy 31 times because she believed that he wanted to marry her.
She said that the only reason she agreed to sleep with him was that she loved him and thought their relationship was 'special'.
She also kept meticulous records of when and where they had sex, which included various places in Sitiawan, Teluk Intan and Ipoh between 1998 and 2001.
However, Ms Nagamah denied that she kept the records to keep Mr Punnosamy from running away from her.
Mr Punnosamy had claimed in court that he had never promised to marry her, adding that it was Ms Nagamah who had seduced him. He said she was the one who would usually contact him to ask him out.
He also admitted that he had had sex with her 'more than 20 times', but insisted that MsNagamah was only a friend.
During his judgment, Justice Mohd Azman said he found Ms Nagamah's testimony to be more convincing than Mr Punnosamy's.
He ordered the man to pay RM50,000 for breaching his promise to marry her.
Another RM2,000 was awarded to MsNagamah as compensation for MrPunnosamy assaulting her in 2002. He had slapped her after she had supposedly threatened his fiancee at a tuition centre in Teluk Intan.
He was ordered to pay another RM20,000 for Ms Nagamah's mental anguish and loss of reputation, name and honour, as well as costs.
Mr Punnosamy's lawyer, Mr Abdul Malik, said that his client would file an appeal.
Neither Mr Punnosamy nor Ms Nagamah, who are both from Teluk Intan, were present for the decision.
Outside the courtroom, Ms Nagamah's lawyer Mr S Muthuveeran, told reporters that his client was still single and suffering from the stigma in her community because of what happened.
'She was really in love with him,' he said.
'That's why she felt so cheated.'
