Just because he is mentally retarded does not mean he is not capable of understanding that what he did was wrong. If he is so severely retarded that he was not capable of understanding what he did or that his action was wrong, then his lawyer could have pleaded that he lacked the mens rea for committing the offence.
We have to conclude that the court found him to be capable of understanding what he did was wrong but nevertheless committed the offence. Therefore he must be punished in accordance to the the law.
