how much compensation will a laid-off employee get under labour law?
heard the rule is
(1) permanent staff - if resignation requires x months notice, then x months salary
+ year-end bonus
(2) probationary or unconfirmed staff - $0
anyone know is this true?
Can check out the Employment Act in MOM website, may have relevant info.
http://www.mom.gov.sg/publish/momportal/en/communities/workplace_standards/employment_standards/the_employment_act/Retrenchment.html
From the link, if the person has worked for only 2 years, he will receive salary of 2 weeks + unconsumed annual leave. More than that is ex-grata payment.
Under the Employment Act, an employee who has been employed in a company for at least three years can request for retrenchment benefits if he/she is retrenched.

varies with different companies..
though MOM states so..bt if the company wants to be cunning & despicable..they can simply state a reason for you to leave..e.g. "cant perform job tasks assigned"

If a company simply state a reason,...that will be victimisation, you can sue them in civil court or thru Abitration Court under the Labour unions. All companies in Singapore are urged to practice ethical management. If I cannot perform the tasks, the company should hv removed me before confirmation, once confirmed, i am deem suitable and capable to perform my job scope within that amount of paid. If bosses ask you to perform a job that is way out of your scope and paid structure, you can alway tell the boss that you cannot perform unless he sponsor u to take courses or upgrade you thru OJT. All things are negotiatable, dun go into a job with your eyes close and agree to everything. Dun be a "YES" person and latter regret it.
laid off due to retrenchment = depends on length of service & collective agreement between union, supposing staff is covered.
laid off due to termination = only 1 mth notice or depending on Employment contract sighed, notice period.
laid off due to dismissal = nothing ![]()

oh no, reinstatement is very unlikely, even so, do the boss still dare to employ me after wrongfully dismissed me, what i want is to seek compensation.
no doubt we can never beat a company, how can a egg challenge a stone? what we want is to seek a revenue to bring out our grievences so that bosses should know their limitation.
worst come to worst, just like some forumers here, post bad about the company here lor..give them a bad bad reputation.

if the company is really in bad shape, what can u do??? they are transparent enuf to tell you that they are not doing well, especially those chinese company, list or not, once finished, no global HQ to help out. What we are looking for are those unreasonable bosses who got cash and yet find ways to remove/sacks peoples instead of retrenchment.
No matter what it will still be good to know your rights under the Singapore's law. So you will know if your company treats you unfairly, will aid you in making any subsequent decisions.
