Hi can anyone advise me how to take preventive action from being cheated from freelance programmer? Recently came across a case, paid the programmer but work not done.. can there be legal action taken?

i think you better learn the lesson of paying after job is done rather than pursuing after the freelancer. If he/she has a registered business company, you can still get him/her, but if he got nothing but just a mere fren, you get nothing out of it, the police or whatsoever laws cannot take on a paperless agreement between two people. The fact that you are engaging an illegal unlicensed business transaction is already a crime.
Actually a case my friend encountered im just helpin to ask ard to see if anything can be done.. they did have a contract signed but not sure is it valid??

since freelancer no have co. name, must put full name and IC
and pay deposit first.... after work done and to satisfaction, pay the balance.....
So does that means to say a self drafted contract is still valid when it comes to legal action? if let say the freelancer nv submit any work can go according to contract to do the claim (as in legally)??

Great.. There is black and white with signatures so i guess i can make some legal claims against people like this.. but now my friend also don know go where to make the report i guess normal police don due with things like this.. Any advise for this... :)

Yes. The self drafted contract is valid. However, there are a lot of holes in a self draftcontract. Is the exact work to be done stated clearly (quatifiable), along with sitpulated completion dates? This is one of the most impt paragraph in the contract.
To claim against the freelancer, u've got to get a lawyer urself to file the case. The costs can be very high and may outweigh the compensation u can get back. And depending what u actually write on the contract, it may or may not help u.
I suggest u make the freelancer believe that u are going to claim against him no matter what, and u hope that he completes the work or pay back the monies.
