I am helping an old aunt (landlord) to seek some advices on rental of his hdb flat. Last year she rented her flat to the present tenant. The contract was 1 year and it would end soon, and the agent turn up to ask for agent fee from both the landlord and tenant for renewal. The agent ask for 0.5 months from both parties. A total of 1 month for renewal of 2nd year.
The questions are:
1. tenant want to stay for another 2 years, but agent say have to renewal every year and pay the agent fee yearly. No such thing as renew 2 years.
2. agent say landlord, by law, cannot talk to tenant on renewal. Everything go through agent.
3. agent open receipt to ask both parties to pay 0.5 months each. Total of 1 month.
4. both landlord and tenant, blur blur sign the tenancy agreement.
Someone can help with the above questions?
Both landlord and tenant are simple people, don't know law (who does?). 0.5 month to each of them is quite a sum of money. What can they do?

simple.look at the contract.
agents usually put in a clause for renewals....but from what I have seen...these clauses are pretty simple in the sense that they only state to pay the agent when contract gets renewed once...havent seen things like cannot sign 2 years.where got by law landlord cannot talk to tenant about renewal?who's law?most likely agent's law because agent scared they come out with some idea to bypass the agent fee...
bottom line is...dig out the contract and see.
i saw the tenancy agreement, didn't say about renewals. I feel the agent is acting like a bully of old folks, scaring them with so called law. Who or which organisation can help?

You can do some research online or you can get legal advice from any law firm. I'd be happy to recommend one if you'd like but if you don't mind paying abit more for a reputable firm, try Lee and Lee.
On the tenancy agreement, previously i saw the new agreement, nothing about renewal. However, the 1st tenancy agreement got say must go back to agent for renewal. So their fate is sealed? Everybody become agent, rich rich?

most likely sealed....that is why contract must see properly.
