I want to terminate my rent contract as I cant stand my landlady. She stays with me.
I pay her rent every 15th of the month and our contract suppose to end in 5mths time.
I told her I want to move out 1st of February but she insist our monthly rent is 15th to 15th and want me to pay another month rent.
She already forfeited my deposit but still want another month rent.
The contract was not stamped because she dont want to let authority know she is leting out the house.
Can i take her to court if she insist of me to pay 1 month rent!
Legally defined, stamp duty is a tax imposed on instruments and/or documents, and the stamp duty is imposed by the Act….i think is Chapter 132….of the stamp duties act…if I didn't recall wrongly. It states that an unstamped tenancy agreement would not be admissible as evidence in court.
However, an unstamped tenancy agreement is not null and void or deemed ineffective. It simply means that it is not legally recognized by the court of law. However, once the late dues are paid in full (incl. penalty imposed….usually very high penalty), the tenancy agreement may become admissible as evidence.
So, the landlord will not be able to enforce the terms of the tenancy agreement in court until its stamp duties are duly paid in full in such cases. Further, the courts may also rule it as offences under the Act dealing with evasion and intent to evade duty.
For this case, there may be other contractual terms that may rescind your claims….subject to what you have agreed on paper….do check with the lawyer…..

No stamp duty means tenant will get into trouble, because stamp duty is borne by tenant. ![]()

She gives you shi wu, 15th, you give her zhu yi, 1st, fair mah
