so how to get your phone back
1) ask from your teacher humbliy in person for your handphone back and tell him and her you are sorry ( phone given back case close)
2) if that fails, tell your teacher your parent wish to speak to them if you have their support
3)if your parents cant get back for you, have them see your schopl principle with you along and make sure the princple knows your case, better still have the same teacher in the principle room, again be humble and respectful. if you still cant get the phone back, let the princple and teacher know you r taking this case to MOE and make sure you have the teaher's full name, princple full name and the school name and do also let them know you intend to file a police report.
4) get your parents to call up MOE and have them talk to them if you have the support, if not you talk to them and ask for assistance, if they refuse, tell them you would make the case big and file a police report for theft from teacher. Better still, if it was forcfully taken away, you can report of intention to ceause harm (if you do get hurt) and molestation if they do touch you in the process, do be very careful when you make such claim and reports (works better for girls) as you would be responsible for your word and action
5) make a police report for claim of theft and maybe even molestation and cause of hurt.
i suggest you start from 1) and only in the last resort to ever go to 5)

Aiyo, you guys really arh, comprehensive skills machiam got prob. I said in my post that in my case NOTHING happened, my phone rang because I forgot to silent it. The teacher didn't know if I got use or not so she just took it. I didn't complain. 20 mins later the lesson was over and she gave me back the phone. Then it reminded me of my friends' phones that were also taken, but for a month. ALL I WANTED WAS TO KNOW WHETHER THIS IS LEGAL OR NOT, AND CAN YOU ACTUALLY MAKE A POLICE REPORT/SUE. I don't really see a reason to use phone in class because all my friends are also in school so most of the time nobody text. My phone was confiscated on May 17 and returned on May17, no teacher is holding my phone now. Geez are you people dyslexic or what?

Forgot to silent it, by the time I took it out of pocket to reject the call from a friend who called me for no reason the teacher already heard the ringing. I don't think I'll ever need those tips you said but the way you wrote it, it seems like it is illegal to take a phone away without returning, by the end of the school atleast.
You shouldnt see it as whether if this is legal or illegal, coz this was done by your teacher to provide a suitable environment for all ur other classmates to study. That is your teacher's responsibility. Looking from another perspective, your teacher will get reprimanded if she/he does not do something abt the phones disturbing ur classmates.
Comparing it to the real world outside; takr example illegal parking and your car gets towed away. Of coz its not illegal, coz you broke the law in the first place. Its only right for them to take ur car away if you don't do so. You can only argue the case if in the event they kept ur car and it was damaged. My guess.
I think ur question here is not abt if its legal or not, is more like whats the maximum no of days a teacher can keep the student's phone.
And fyi, in my sch DM keeps it for 1year. Hes an ex police officer too. Just continue being a student and someday when u start working, you'll understand why all this happens.

1 year? I think that's too much. The reason why I see it as illegal is because it's YOUR property or your PARENTS' property. What gives them the right to take it away? I've been to some museums overseas which says no photography. I took some pictures and the security demanded the whole camera, not just the SD card. Obviously I didn't give him because he's just a security guard. I just walked out of the museum like nothng happened. If teachers confiscate something for more than a day, can you garauntee what he's doing with it? Maybe on the way to his office he dropped it twice? Maybe he still using flip phones and would like to try smart phones? Maybe he give his son to use? Who knows what he's doing? Even people with high authority like police need a warrant from court. If a police suspecet you are holding something that poses a danger to the public, they also won't take something for more than a few days just to check if it is dangerous or not. Teachers get warrant from who to take your phone for one whole month? Morally it is correct, just like how killing someone who killed your mother is morally correct too, but is it legal? Don't think so. Anything more than a few days is too much IMO.
