  Hi my ex colleague got some problem. He rented a HDB flat from an owner for 3 years. But only sign the tenancy agreement for the initial year. Subsequent years he did not renew the contract with the owner because he says they are nice person so continue the rental base on trust. Now he decided to go back to Malaysia help out his family business. But the owner refuse to return him the deposit deducting a lot of things from the deposit and still says not enough. My friend says fair enough for the owner to deduct some deposit for some wear and tear and he did not clean up the place when handing over because he is going back in a rush. But the owner totally dun want to return him a single cents. Is there anyway he can seek a recourse for this? Can make police report? Can complain to HDB? I ask around but some says can some says cannot because he dun have any valid tenancy agreement to begin with. But in this case can report to police for cheating? Please advice. Thank You

  Not says not maintain properly. Just that he left in a hurry and the landlord says ok. He also ask the landlord to deduct his deposit accorddingly for any cleaning needed to be done. But not until $2000 right?

  Ask him for breakdown for wear and tear and ask for proof of receipt. If he doesn't then can take up case to mediation board to resolve dispute.

  iciboi is spot on.

  Don't think you need a legally binding tenancy agreement to sort out disputes like these.

  Both party will have their own risk where there is no binding tenancy agreement filed.

  By going through mediation board to resolve dispute also won't help, as you have nothing vaild to support yourself.
