Let me tell you this. I once took pictures and video with my HP cam and showed how a cab driver showed me 3rd finger and yelling KNNCCB etc. I downloaded it on my computer, zipped it and emailed Comfort after that.
The next day, they sent an email response and a week later, a formal email was sent citing the actions that they took. On speaking to some cabby, getting complaints is taboo as it affects their ratings and they lose some kind of bonus. They will be in the losing end.
Moral of the story? They have to really behave.
In your case, it could merely be a case of sleepiness. Live and let live. It is his rice bowl.

Have taken down his number but wat can we do? His company is not going to take action? As we need witness.
It is best to install CCTV to it and take down the incident moment than submit to the press rather than to the company.
