Criminal Intimidation, from a legal standpoint, requires the charge to specify whether the alleged threat was one of injury to "person", "reputation" or "property". The words spoken by Gomez - "implications", "consequences" and "something must happen", are very vague and unclear in this regard.
In any case, Gomez asked ELD to "check again" and to call him back on his mobile phone. In other words, Gomez wasn't going to do anything pending ELD checking again and getting back to him. So where's the threat?
Criminal Intimidation is out of the window. -
