As for how they find out u are downloading music, I think it has to do with a list that RIAS provides to investigators. Im not sure, but I am guessing now. In this list, perhaps there wuld be a list of tracks that may carry a certain tracking code in its mp3 code.
From there, maybe all they have to do is follow that "extra" pattern in the mp3 to the ISP, and ISP to the mac address.
Of course, it will take a while to proliferate "specially" coded mp3s. The possibility is that those special mp3s have already proliferated enough for RIAS to issue out 1400 over warning letters.
