Two Charged With Illegal Music Downloads.

  both allegedly put up hundreds of songs, since 2002, on a popular local internet relay chat channel for other users to download.
  
  Mohd Faizal Osman is a 21-yr-old unemployed. Mohd Azry Zainol is a 22-yr-old factory operator. if found guilty they could be jailed up to 5 years and fined up to $100,000 each.
  
  a 16-yr-old student was also arrested, but was let off with a stern warning by the police on account of his youth and good school record.

  wow..sure or not? Two malays kana charge...the other because of good record in sch or whichever sch is he from, being let off? What kind of justice is this?
  Hate it when the judge always takes into account his/her sch reputation and academic record...
  What has that to do with going into crime anyway!

  I have a question. Last time civil case those RIAA/MPAA lawyers will sue the defendant for a large sum of money. I think is a few thousands for one song. So now criminal case liao become govt prosecutes.
  
  So will the record companies get the money? Or issit they can sue independently and the accused cum defendant will pay the fine + damages.

  blame the skewed FTA.
  
  I don't know how the policy team got snookered by the RIAA industry and the corporate interests of the United States music industry.

  Ya, i think the criminal charge is separate... the record companies can still take up civil action against the defendent.. cos fines go to the government, not to the record company.

  I wonder if they track people who download songs from websites... seems like those caught so far were for uploading/downloading via P2P networks.

  Download from allofmp3.com lah. Cost for one album is usually about US$1. It is hosted in Russia which is not a member of the WTO. They have a different standard of intellectual property protection and all downloads from the site is legal under Russian law.
