The bottom line is all about marketing. Apple marketed their iPods as something trendy and fashionable to have - and its visually appealing asthetics pander to the masses.
Creative, on the other hand goes on and on harping about how their players are better and cheaper than iPods without focusing on what the consumers want - trendy, reliable MP3 players.
And I think sueing Apple is a really bad idea - it brings about the impression that they're getting desperate.

I brough it back to Apple service centre, they took a look, make me fill up a form, and fix a date 1 week later for me to go back. I did, and got a brand new player, some free songs inside it too! Creative simply did not have enough money. If they can't even afford to invite at least a famous band to give signatures, and used Sim's, how could they possibly get those big stars. Yup, iPod is like so iconic already. Read a newspaper article just now, about the UK's airport red alert against the planned terrorism which was being discovered. The reporter wrote "Devices like laptop, cameras, cellphones, iPod etc are banned from the plane, together with all other types of handheld bags." See, instead of writing mp3 players, its iPod. Just ask anyone who heard of creative dicsman like hardisk player before? I think many ppl still remember the ipod funky dancing ad. This show apple mkting power. Apple learnt her lesson well. When sim realised his mistake apple has successfully differentiate her product. Zen is no longer deem a direct substitute of ipod.
on the lawsuit i will saw that it is done out of desperation. Creative final trump card against Apple. Creative forgot one thing though, Apple has a group of commercial lawyer to defend her. Throughout Apple recent history, her defenders have never really let her down.
ps: i will not reccomand buying creative stock now. I believe that her earnings will drop in the next financial quarter due to the lawsuit and the removal of tax rebates.
