  you didnt suffer any loss so where's the basis on which to sue the fella? and besides the fees incurred will probably exceed the value of the item you're selling

  Verbal contract is a contract and sue-able if defaulted on. Thats a basis of law. However, the petitioner for such a suit must provide a lot more details.
  
  From time of that agreement to even a recording if its available.
  
  If its on a SMS. with CLI and so on. It can be transferred to paper and thus becomes black and white.
  
  That agreement is enforce-able. But it will take a lot of effort and some extra $$ to make it stick for presentation in court by a lwayer.
  
  I believe in any transactions, its always better to take on a deposit, so that if the buyer were to backed out. The seller wont lose out much.
