Who is the murderer? Part II

One day private Rodney came to the station and ask Inspector Lim about a very bizzare case that happened yesterday.... on there was this man called uncle John who is 40 yr old was killed in his study room on the second storey of his house. When looked into the house apparently he put up a pretty good fight against his intruder before he was killed. In the house there are altogether 7 other person... They are all the suspects.
1) Bodyguard
2)Son of 8 yr old
3) Wife
4) Nanny
5) Maid
6) Butler
7) Cook
While interviewed... they found out that The body guard was out early in the morning to town and back the very next morning drunk. The Butler was chatting with the Maid thru the night at the lobby with the television and the only staircase up resided. The cook was sleeping in the room next to the staircase. The Nanny was with the Son coaxing him to sleep in the son's room at level two. The Wife is in the master bed room 2nd level too. There was nothing in particular that happens... No one was seen up and down the stair case thru the night. But The Butler was having a severe diarrhea and keep going to toilet. The cook was in his own room and woke up the next morning. There was a sound on the roof outside the house. Upon checked by the butler and maid they found its just a cat. Television is showing horror show. Window is opened at the kitchen at level one. And finally because the study room is sound proof... no one could heard any struggle.
Can you help inspector Lim solve the murder? Who killed uncle John and how did he do that? -

Bulter , maybe he used some of the time after he went to the toilet to get a chance to murder John ?

Since I am not a witness nor a detective, I will leave it to Inspector Lim to solve it. That's his job

Use elimination and you'll have the suspects slowly figured out.
1. Put up a good fight with suspect -> Son is out
2. No one was seen up and down the stairs -> Bodyguard is out, as only the kitchen window at lvl 1 is open
3. Nanny was coaxing son to sleep -> Nanny is out, as Nanny has a witness
So you're left with the wife, Butler, maid and cook.
Maid was watching horror show on TV while Butlet heads for the loo.
Cook was busy sleeping.
What is the wife doing? -
The butler was going to the john (loo) -> aka kill uncle john

Judging by the information given,
The murderer is the Cook.
First of,
Bodyguard - only ways to get in to kill is by window in kitchen,
or by front door during the sound on the roof checks.
but he won't know if the window is going to be still opened at night,
unless he is in cahoots with the cook. but then he won't know
the situation in the house, thus cannot plan who will see him.
since he's a Bodyguard, he'll probably ownz uncle John (not pretty good fight).
8 year old son - since uncle John put up a pretty good fight,
it wouldn't be his 8 year old son.
Nanny - since she is accompanying the son, the son would have
noticed something strange about her, plus she's a female.
see above pretty good fight.
Wife - female, looks like the best person for the job, but a murderer
will create impression that its not him/her, plus she's a female.
see above pretty good fight.
(high chance she's in cahoots with the Cook - reason for the murder)
Butler - he could be lying about having a diahaerra, but since he keeps
going to toilet (assuming toilet is in the first floor) he has no chance to
commit crime because the maid is at the up resided staircase or with him checking the roof.
Maid - only person "guarding" the staircase, but the only strange thing
happen in the night was the sound on the roof, and she is one of the
two that went to check, so its not her plus she's a female.

Cook -
open window in the kitchen is likely by him, reason being:
1) he didn't expect the maid to be there, so he went to the kitchen,
thru the window, makes a sound on the roof (or release the cat to the roof).
2) makes it looks like somebody from outside did it.
3) creates an impression the Bodyguard would have escaped from there
it is most likely him because:
1) he's on the first floor (able to access the kitchen)
2) he has the ability to let the butler get a severe diarrhea,
able to make the butler will be visiting the toilet often
3) he's a guy and likely to put up a pretty good fight with uncle John
4) only person to ensure that the kitchen window would be opened

The room of the cook is right beside the staircase
The first hint is: Since he put up a good fight.... The intruder must be strong enough or equal to him to fight him.
Try thinking out of the box... coz thats the only way for the answer...
