If they had collected the information passively, just by sniffing or whatever methods, this evidence will stand. Provided they have a log of sorts to prove that it is the real traffic, not some dummy traffic they have generated.

and even then, the evidence is still valid. how believeable is another issue and is up to them to convince the judge. actually i feel the judges are probably not adequate enough to judge in this instance given they probably don't know alot about such stuff.........

ODEX luck could be changing, unless Pacnet lawyers can think of better ways to whack ODEX.
The licensing issue might not be as strong now, because this judge is asking for technical evidence. That means Pacnet will have to counter using technical evidence as well, other than the licensing issue.
