Why are they so silly? It's fan-subs afterall right?
So technically people record those anime from FREE tv broadcast in japan and then translate them into subtitles to share it.
Therefore, they can't sue those people who downloaded fan-subs cos those people do not know it's illegal to do so. I mean put it this way, if you happened to record a mediacorp show and then put in your own subtitles and share it with your friends overseas...does that means mediacorp will sue you for it? Can they do that?
Frankly speaking, if nobody made any profits out of this fan-sub issue...there is no case at all. At the most once the person received such a letter make sure that they removed all traces of those "illegal" (to Odex) animes from their premises immediately, Odex might ended up paying more for the court proceedings than the accused (Cos it's easy to claim that the accused wasn't aware that fan-subbing isn't legal in Singapore and wasn't using it to make any personal gain out of it. Moreover, the accused has realised that it was against the beneficial of Odex...therefore had all "illegal" fan-subs removed from his premises upon the awareness from Odex).
If everyone do that, Odex also cannot do anything but they will need to face the fact that the public will be silently boycotting all their products. It's normal in Singapore and it's called politics.

Those license anime r illegally to dl cos it not free 4 all liao. the license holder can sue de. u can dl those anime which have not been license or dl anime be4 it licensed r consider legal. But bear in mind that other country dun license some of the anime does not mean sg dun oso. Any thing that is under copyright by lawr consider that dling free from net or distribute arnd r illegally and u sure get sue.

If what it stated is indeed true, why dun we fan of anime group together and pool a certain amount of $$$ (by donation) to some of those poor soul being issue the letter for them to fight out the case in court. If more then one of us are willing to fight it out in court, I believe the sheer amount of court case bills that odex have to fight will eventually bankrupt them. After all, without their 3k or 5k profit from each of their letter issue, they now have to pay for both the law suit and their so call anime crack down fees.
If starhub are charging them for revealing 1000 IP detail. I am sure gathering evidences through searching 1000 household isnt really going to be easy nor cheap. The amount of fees and effort for count search warrant, etc will going to cost them a bomb.
But if they are going to juz sue a few of them, we will know at least where the law stand. After all the strength of many out weight the power of one.

There can be only ONE winner........so......they had better get proper advise to weigh their chances of winning the court battle.
You see.....lawyers being lawyers, they will always tell you that you can win your case or have a fighting chance to win, against the complainent [Odex in this case]. Win or lose, lawyers still get paid. [Defending lawyers looking at their clients as Cash Cows too....hmmmm....perhaps..heheheh]
If the alleged subscribers [ie the defending team] lose the court case.....they will have more than just having to pay up the initial $5000.00 demanded. They will also end up paying the court fees, conplainent [ie Odex] lawyers fees, and their lawyers' fees!!
That's gonna cost more than the $5k demanded from each alleged downloaders.
And what about Odex?? No extra cash outlay. Cause, Odex's lawyers fees for the court case will be paid by the losing defence team [ie alleged subscribers]. End of the day......Odex boss still get to bring home the bacon.....heheheh.
Unless...........Odex.......slip up and lose the court case......!! -
i tink we shld stop downloading for the time being, then start when u get a high speed wifi card, use a proxy, then change ur IP address, sit somewhere and start ur torrents and hog the bandwidth

and i have some basic knowledge of the copyright law.. but this is a little too complicated since it spans from the creators in japan and the japan tv networks to the end users in singapore.. but my point is the anime that "we" download is not odex's version.. it's fansub from japan.. so technically is nothing to do with odex wad.. shld be the japan tv networks sueing wad.. -
Under Japanese law, there is scope allowed for redistribution of a work that has already been broadcast free-to-air, provided that it is non-profit and not meant for commercial purpose.

but sadly, that will never be the case.. so, don't be cheap.. import from overseas, pay for crunchyroll @ potentially less than $0.50 per anime instead of your claimed "I won't pay $3 for 1 anime episode"

but it does mean that downloaders are not ENTIRELY in the wrong. in fact, they are quite innocent - the only problem here is that those who have been served the letter choose to settle with ODEX thru the payment of $3,000 to $5,000 without going to court to fight for their rights which may end up costing more or less depends on who wins..
as usual i guess pple just want less trouble.. -
