Victim of Hardsell tactics at California Fitness Gym

nowadays, there are more so called "free vip" priviledges from those fitness center and yoga centers. they call u (and god knows where they obtain ur hp no. from) and said ur friend referred u in the lucky draw and u are so lucky to be the lucky one. i have encountered 3 times for the past 2 months.. and the poor telemarketer have to endure my scolding..
all they want is that u agree to try out that 2 wks of vip package, meanwhile, they will charm u into buying their package when u are @ the center itself.
and its been the trend that they are giving away these 2 weeks vip trial when u sign up for credit cards or other membership cards else where.
beware.. there isnt that many free lunches in this world. -
I think TS is regret of his action. And now try to find fact to back up his regret so he can don't pay his money.
No one can force you upon on something you don't want.
You sign on your own will, then why keep say confused.
Just bear responsible of what you did. How can you still sign when you confused.
Anyway, what i try to say is just get over with it. cause there is nothing you can do about it. Just treat as a lesson to grow up .

Alternatively, you can create your own gym mah, buy a few dumbbells that suit you, a static cycle trainer, a bench, a mat, and maybe if affordable, a few pull and press equipment, as for running, you can alway go to the park and run.Originally posted by gUms:why not just go to Gyms under goverment , Cc gyms....

For me, even my house area got a gym which is free, i still go to park to exercise on those benches and equipment provided by the govt and then jog a few round will do. Take in good natural oxygenated air from the surrounding trees and also handsome boys/hunk to look for, and yet not even spend a single cent spent, why not?
Some of my gal friends also patronised all these expensive gyms in clubs and fitness centre, but I dun see them slimmed down or even toned up, so my conclusion is if you really wanted to exercise, you dun have to spend. -

Since you had signed the contract, under the contractual agreement, you had allowed them to deduct money from your bank. However, you can authorise your bank to stop this deduction, but then the penalty of not paying up or so call ceasation of contract by you is your liability, i.e to say that they can sue you or alternatively ask for compensation from you.
Case will take in your complain, but will not withdrawn your contract signed with the fitness centre, because they do not have the right to do that, the only thing Case will do is to hold a talk with the mgt of the centre, and if needed, warn the centre that they can be blacklisted if malpractice is provern truth. Remember, Case is not an agency for prosection but rather to provide consumer an avenue for better services.
Whether you are a victim of harassment or not, you had signed the contract with your EYEs OPEN. And in the law of the court, anyone above 21 yo breached a contract he/she signed and agreed upon with his/her EYEs OPEN, is liable to be prosecuted to pay compensation to the principal party he/she signed with, be fined by the govt. and shall foot all legal costs as necessary. And that to my experience, minimium 20k. I gather it will be very difficult for you to win the case, unless you can prove to the court that you signed the contract with your EYE Closed, that is, you are forced, drugged, stimulated, threatened, hallucinated, sabotaged, conned, or at gun or knife pointed. If you can do that, the prosecutor rest.

I have a friend whose son was pestered into signing for the package. My friend went up to them to tell them off. he finally got his son to withdraw from the package but foot half the bill as a contract is a contract.
i think you can look into the following
1. if you are below 21, are you legally allow to sign a contract
2. don't wait....see case as there is a cool down period.
I hate these people who pressure sells. leave the gym. if you really want to go gym, go those that are paid per entry like those in ntuc -

Help him resolve this issue - fix the root of the problem !! The problem is himself !!! his character, his ego !

Call your bank to cancel the pay and the credit card too. Make complain and what more have to change your mobile number if they still call you.
I normally won't give out my mobile number to these people as they will just call non-stop until you agree on their package. I cmask my number so I can block them anytime if they are harassing me. -

From the situation you have described, I believe what the manager had done constituted an unfair practice under the consumer protection Act because the instructors exerted pressure on you and the manager misled you into signing the contract. The amount will only be credited on 11th Dec, bcuz I said I will only have money in Dec. I just anyhow made up the month, becuz I wanted to drag as long as possible, if not I will have to pay immediately.
Don't worry too much. Explain your case and situation accordingly when you meet the CASE representative. Don't miss out on any vital information.
Whatever the outcome, I don't think you would want to walk or go near that gym again. After settle everything, cut your gym card into pieces and throw them down the rubbish chute. -

Cancelling payment doesnt help if the contract is still in force.
In fact, by cancelling payment, TS is defaulting payment, he can be sued for defaulting payment or be asked to pay interest.

your advice doesn't seem particularly good either by saying his case is weak.
If TS does as I say he will have no more problems but if he goes to CASE he can wait many months before he gets back his money or if at all.
If you file a dispute management form, the bank will have its legal team to address the issue on your behalf.
Not that I am arguing against you but it is not your prerogative to say whose advice is good or not - the decision lies with the TS and we are giving him input as to how best solve his problems.

It's been resolved and I don't even need to go through CASE.
My friend knows the most senior manager there and she spoke to him. I also went there to speak with one of the trainers. After a few min, almost 20 of the trainers gathered at the 3rd floor of the gym for a discussion which I assume is regarding my case.
Then just got a message from my friend around 6pm that my case has been resolved. I don't have to pay anything.
