Hi I just consulted my lawyers and their opinion and big guesses are Sun Microsystems are up to intimidate us with a letter since we are such a small company... Same opinions that I got here as I got from them... If they want the website, they should pay... Nobody gets confused between a product and a company... So they better have a good case against us...
Apart from that I would also like to thank bananaCoke for bringing to our attention that our site is actually very valuable because in a typical search of glassfish, it comes up top 3 in Yahoo.com....

Glassfish server has been around for more than a year, 2 or 3 if I remember correctly. Thing is, even though u are a singaporean company with a singaporean website, there will still be some measure of protection for Sun due to Singapore's FTA with the US. Part of the FTA was regarding intellectual property if I remember correctly.
Get a new domain name. Try something like glassfishdesigns.com.sg

Yup... We are actually in the midst of updating our site... So there are quite a number of things that had to be taken down to be improved...
We don't mind changing the site... But to give them everything so valuable for free is the issue here.. After consulting with our lawyers, if Sun Microsystems really feel they have a strong case, let them bring it to our doors. We will go through this all the way with them...
However we do really hope we can settle this peacefully and come up with a fair settlement. That would really help both parties and mitigate legal costs as well... But then again, Sun Microsystems being a huge MNC, could do what they want since they have huge budgets for things like that.. But whatever it is, we won't be going down without a fight... or an amicable settlement/agreement....

Actually it is closer to 4 years, since GlassFish started in 2005. However,GlassFish was not registered as a product until March this year.

Hi Ignatius, I believe you should update your website more, as if Sun's find that you do not really capitalize that much use of the website, your case could be weaker...so upload more info etc onto your website.
Another thing Sun's will most probably check out on your website is the no. of people assessing your website to define your damage. If not much people have visited the website since it has started, then you really can hardly get any payments, then in that case, the strategy would be to "work" with them rather than against them, for future collaborations, etc.
And Sun's probably going around to search in the internet for any defamation sources that your company may have on them. So I advise that you take down the uploaded images of the legal letter, and be careful of your wordings/replies in the forum just in case they bite back at you, and counter sue you for damages.
Then, will your back also protected, your case should be looking great. :)

Honestly the legal letters will stay here... I'm not going to hide the fact that there is a problem going on here...

Bcos their product started as public domain program and under GNU regulations since 2005 and your company just started in 2009. Most likely, they are suspecting that your company are riding on the fame of their product, hence they sent a cease and desist letter to your company.
