What if there's "agreement" to drink alcohol and have sex? Is that still non consensual?? I mean, what if both parties had "agreed" that there will be sex and alcohol BEFORE drunken state sets in?Originally posted by anfuni:u are wrong.... being in the state of drunkenness is already constitute as non consensual... and they can be charged for rape or even outraging modesty..... the main problem now is how much evidence she can gather to prove that she was involved with the two guy.... rather than thinking that help can be rendered from the police....
call/visit a counselor and see wat he/she advises now.... do not wait further...

do u mean the Shankar case? In that case there was no question that she was drunk, he said as much, yet there is nothing to stop him from putting up his defence, was there? That means it can still constitute consent, unless she has passed out totally. But in this case if she can still agree to play games and all... how can you prove that no consent was given?Originally posted by greyskymorning:agreed.. a v gd recent eg is the CNA guy being charged for having sex with drunken female colleague

Get professional help from your school counsellor or a telephone hotline.
It doesn't make sense to ask for help from a forum about such heavy topic.
cant tell u much... cos i bad at expressing.... be a lawyer... then u will noe how to fight such cases.... evidence is the crucial thing.... thats y alot of witness is necessary.... however of cos final say still lies on the judge...Originally posted by Elrond:do u mean the Shankar case? Jury trials were abolished in 1969. The Criminal Procedure Code was amended in 1969 to provide for trials of capital offences to be heard before two Judges and a jury. The accused would be convicted only when the Judges reached a unanimous decision on his guilt. This arrangement continued until 18 April 1992, when the Criminal Procedure Code was once again amended to allow for trials of capital offences to be heard before a single Judge.Originally posted by doghouse837:thanks for telling me this
